The argument can be made that it’s totally a fluke, but the choice of colors is the nail in the ripoff coffin.
And why not just commision you to design it in the first place?
This happens all the time though, checkout flight404.com . A high end retailer stole his flocks of birds off flickr and made a shirt design from them.

Nice that Ben responded to you too, but wouldn’t you think that they would have the integrity to take a look, and see the blatant rip off of your work, and say “hey, we are not going to sell these any more. Hell, we (Smartpunk.com) are going and return the merchandise to its manufacturer, telling them we do not support their “visual appropriation” practices, and ask for a refund. Maybe I am just too naive and have been in academia too long, (disconnected from the “real world” ) but that would seem to be the noble thing to do instead of saying we don’t make em’ we just sell em’!

Which I LOVE! Partly due to the mishmash of images & type.
Like Snoopy and a Nike logo with the word “Pefdom consenualism” below it.
It’s like a cultural lens, how others see ourselves.

wow that does suck… i suppose taking legal action would be both time consuming and financially taxing.
